Terms of Service

DEFINITIONS

In this Terms of Service, the following expressions shall have the meaning assigned to them
unless stated otherwise:

MWP Acronym for My Weekend Plan Sdn. Bhd.
Account Refers to a registered account created by a User to use the Website and to utilize the services provided by My Weekend Plan’s Website.
Users Refers to people who visits the Website, uses the services of the Website and/or engages the Services of Providers through the Website
Providers Refers to individuals who have registered as partners on the Website and have offered their Services to My Weekend Plan either on or off the Website.
Participants Refers to those who have paid My Weekend Plan for the Services of the Provider.
Services Refers to any information, service or product provided to My Weekend Plan on the Website or off the Website that connects Providers with Participants and vice versa.
Events Refers to any corporate events, private events, team building activity or group activity which is 10 pax or more.
Website Refers to myweekendplan.com.my and any other related websites owned and operated by My Weekend Plan Sdn. Bhd.
You, Your Refers to Providers, whether individually or collectively.

 

Access and Use of Services

Account Registration
In order to provide your Services to MWP and/or use all the features of the Website, you will have to register as a partner on the Website. MWP will then conduct a screening process to ensure the quality of your Services. After passing the screening process, all Providers are required to pay a deposit of make a deposit of RM200. The deposit will be returned to the Provider if the Provider decides to end their partnership with MWP, provided that there are no misconduct or violations of MWP’s Terms of Service.

Providers are responsible for the information that is provided to MWP. All information must be true and original to the best of your knowledge. Failure to do so, may result in your services being blacklisted. MWP reserves the right to refuse registration or terminate your account if any information provided during the registration or thereafter is found to be inaccurate, false, or
incomplete. MWP also reserves the right to terminate any Account that has been inactive for a period of 6 months. All information and personal data provided by Providers to MWP will be protected under our Privacy Policy.
Any Services that are to be listed on MWP’s Website can only be conducted on Fridays, Saturdays, Sundays and Public Holidays. Services provided by the Provider should be submitted to MWP either on the Website or any softcopy document (PDF, Word) to be reviewed by MWP before being published on the website.

Member Account, Password and Security
You are responsible for maintaining and safeguarding your password and your Account. You are also fully responsible for any actions and activities that is taken under your account. If you notice any unauthorized use and access of your account, you will immediately notify My Weekend Plan. My Weekend Plan will not be held accountable for any liability, loss or damage arising from any action or activities under your account.

Service Charges

There are no monthly subscriptions for Providers providing their Services to MWP. MWP will only
collect a fixed percentage from the service fee set by the Provider for any Services listed on the Website or any Services being provided. The amount collected by MWP will be used for marketing and operational purposes.

For the Services provided to MWP for Events (10 pax or more), Providers MUST have a backup contact/partner that will be able to replace the Provider in any case that the Provider is unable to provide the Services for the Events. Providers MUST provide the contact information and other necessary information about the backup contact/partner. Providers providing their Services for Events are required to meet face to face with MWP together with their backup contact/partner to discuss about the Services that they will provide. Providers are also required conduct a demonstration session with slots for MWP’s members to participate.

Payments

As a Provider of MWP, you agree that all transactions with MWP Participants will be processed
through MWP. At no point should you accept money directly from Participants. In the event, a
Participant brings along a companion(s) who has not made payment to MWP, you are required to
notify MWP and the MWP will collect the payment from the companion(s) as this is considered
an indirect lead from MWP. Failure to comply will result in your partnership with MWP to be
reviewed.

Other sites charge an up-front listing fee, an ongoing membership fee, or they charge you for
each lead. Not MWP! We only make money when you do! Failure to comply with this guidelines
may result in your immediate removal from our site. That means our partnership would be over,
and nobody wants that!

MWP will issue the Provider’s payment for the current month, the first week of the following month. Providers can check their outstanding fees through their MWP account on our website. Payment for the Provider’s Services will be transferred only after the service has been provided.

Payment vouchers will be sent by MWP and has to be signed and acknowledged by Providers.
Failure to do so, will result in the holding of the current month’s payout. MWP will make payment
the Provider’s designated bank account via Internet Banking. Please allow at least 3 working
days for the payment to be processed by the Financial Service Provider.

 

Cancellation and Refunds

Provider Initiated Cancellations

A Provider is strongly NOT encouraged but may cancel their Services after their Services has
been purchased by Participants. These are MWP’s cancellation terms that Providers will agree
upon;

    1. Providers will be subjected to a penalty of RM200 which will be deducted from the
      deposit that was given to MWP.
    2. The conditions to waive the cancellation charges will only apply if;
      a) All registered Participants from MWP agrees to reschedule AND
      b) Notice of postponement is given at least 48 hours before the agreed upon date
      and time.
    3. Participants are entitled to a full refund if Participants reject the Provider’s offer to
      reschedule to another date and time. In such cases, Providers must inform MWP to perform the refund procedures on the Provider’s behalf.
    4. If a Provider cancels 3 or more times within a year, MWP may deactivate the Provider’s
      Service listing for the next 6 months.
    5. Providers are responsible for ensuring that Participants and MWP are notified and aware
      of the cancellation.

Participant Initiated Cancellations
Participants are not entitled to refunds if they decide to not to participate in the Services provided by the Provider. However, Participants can transfer their attendance voucher to a friend if they are not able to make it or forfeit their attendance. However, if the Provider is able to
accommodate to a rescheduling for the Participant, they are to do this at their own discretion.
MWP will process this transaction as attended.

Absenteeism

In a case of participant absenteeism, Participants are not entitled to refunds. Providers are
obligated to notify MWP within 3 days after the agreed date and time. This is to possibly find out
why the Participants was absent in hopes to improve our services.

Reviews on the Website

Providers are encouraged to prompt Participants to leave reviews about their experience on
MWP’s Website as this increases the Provider’s credibility as our Provider. For every review,
participants are eligible to collect a RM5 voucher issued by MWP that can be redeemed for their
next order!

Pricing of Services on the Website

Services listed on MWP’s Website which are also listed on the Provider’s own website or through
third-party Providers (other e-commerce sites) should be priced uniformly or at a cheaper rate.
This is to prevent price discrimination to MWP Participants. Minimum pricing of the Services is
RM10.00.

Marketing and Intellectual Property

Providers grant permission to MWP to use all materials and information (copywriting, images,
etc) provided by the Provider to MWP for marketing purposes across various channels such as
Search Engines, Social Media and Electronic Direct Mailers (EDMs). These materials still remain
as the Provider’s Intellectual Property.

Understanding between Providers and My Weekend Plan

  • Providers are not authorized to make any commitment or representation on behalf of
    MWP unless specifically or authorized by MWP to do so.
  • Providers are solely responsible for, and will file on a timely basis, all tax returns and
    payments required to be filed with, or made to, any federal, state or local tax authority
    with respect to the performance of the Services and receipt of compensation from MWP.
  • Providers will observe all anti-harassment and non-discrimination laws in the
    performance of their Services.
  • Providers will not list their company information on MWP’s website or on their MWP
    profile. Examples of such information are their company name, company logo, phone
    number, email address and/or links to other websites.
  • Providers are not entitled to any of the benefits that MWP may make available to MWP
    employees, such as group health or life insurance, profit-sharing or retirement benefits.
  • Providers relationship with MWP is that of an independent contractor, and nothing in
    these guidelines, the Terms of Service, or any agreement is intended to, or shall be
    construed to create a partnership, agency, joint venture, employment or similar
    relationship between Providers and MWP.

By listing your Services on our website or submitting your proposals to MWP, you hereby have
read and agreed to the Terms and Conditions of this partnership with My Weekend Plan.

My Weekend Plan reserves the right to change these terms and conditions at any time without
prior notice. In the event that any changes are made to the Terms of Service, MWP will provide
you with notice as appropriate under the circumstances, for example notifying you via email.
Please check your email from time to time for the latest updates to keep yourself informed of any
changes. The continued use of the Website and its services after any such changes constitutes
your acceptance of the revised Terms of Service. If you do not agree to abide by these or any
future Terms of Service, do not use or access (or continue to use or access) the Website or
subscribe to MWP’s services.
